How to Build a Strong DUI Defense

No one ever expects to get a DUI, but when you do, the results can be devastating. However, a strong defense can make all the difference in how quickly you are able to move on and start living a normal life again. Building Evidence In a DUI Case

It is important to remember a DUI arrest is not a conviction. There is still time to build a strong defense to minimize consequences and obtain a positive outcome. There are two factors necessary for a strong DUI defense: a good lawyer and developing evidence. While an attorney will help you build evidence for your case, you will need to present as many details as possible regarding your arrest. Here are some of the things your attorney will need:

Events Leading To the Arrest

You will need a detailed description of what you were doing before you the police officer pulled you over. Were you drinking? If so, how much? Where were you while you were drinking and why were you there? Did you have a reason for driving while intoxicated which may be deemed justifiable in the eyes of the court? This could something such as an imminent threat of danger that could only be escaped by driving.

During the Police Stop

The details of what happened when the police officer pulled you over are very important to your case. It’s important to know that the officer is not legally required to explain your rights to you before conducting a field sobriety test and is also not legally required to inform you of the consequences of refusing to take the test. However, the following factors may help your defense. - How was the test conducted? - What were you required to do? These questions are important to determine whether any factors may have compromised results of the test.

Additional Evidence

Keep anything that was handed to you by an officer and obtain a copy of the police report. You will need the citations issued to you, bond paperwork, court information, license suspension paperwork, and results from a Breathalyzer test  (if one was administered). If the incident involved a traffic incident, take pictures of the damage. Photos and videos of damage to your vehicle and other property can be helpful in your defense. Provide your attorney with information on any existing health conditions. Some health conditions may cause your actions to appear as though you were under the influence of alcohol.
