Every Florida driver with an automobile insurance policy automatically has PIP. Unlike other types of insurance, PIP does not take into account who was at fault for the accident. This means you can get up to $10,000 for any emergency medical condition. If your injuries are not considered an emergency medical condition, then you may only receive up to $2,500.
It is also important to note that you MUST seek medical treatment for the injuries within 14 days of the accident or there is a chance you will not be covered by your PIP.
What Is an Emergency Medical Condition?
According to the 2012 personal injury protection reform bill, an emergency medical condition is classified as “a medical condition manifesting itself by acute symptoms of sufficient severity, which may include severe pain, such that the absence of immediate medical attention could reasonably be expected to result in any of the following: serious jeopardy to patient health, serious impairment of bodily functions, serious dysfunction of any bodily organ or part.”
In order to receive compensation from PIP insurance, an individual must seek medical treatment from a healthcare professional within two weeks of the accident. An individual may seek treatment from medical providers, including physicians, osteopaths, dentists, advanced registered nurse practitioners or supervised physician assistants.

Unfortunately, personal injury protection does not always cover every medical expense. With the high cost of medical care, many individuals find themselves mounted in debt after a car accident.
