Is My Criminal Record Affecting My Job Search?

Is-My-Criminal-Record-Affecting-My-Job-Search

A recent study by the Equal Employment Opportunity Commission found that 92 percent of employers run background checks on job applicants—so it is not surprising that having a criminal record can hinder your chance at getting a job. Fortunately, you may be able to have your criminal record cleared, which can ultimately help you on your job search.

Having your criminal record sealed or expunged can give you a “new” start and is a beneficial option if you are having a difficult time finding employment.

Sealing vs. Expunging

Both sealing or expunging your criminal record can help you on your search for a job; however, sealing and expunging are two different things. When your criminal record is sealed it is not accessible to the public, although the record is still on file at the courthouse as well as the arresting police agency. On the other hand, when your criminal record is expunged, the courthouse and the arresting police agency essentially destroy it and the only party who has access to it is the Florida Department of Law Enforcement.

How Can I Seal or Expunge My Criminal Record?

Not everyone is able to seal or expunge his or her criminal record. In order to have a criminal record sealed, these requirements must be met:

The individual has not been convicted of another crime.

The individual has not been adjudicated a juvenile delinquent.

The individual has not sealed or expunged a criminal record before.

The individual is not under court-ordered supervision.

The individual is looking to seal or expunge an eligible charge under Florida law.

If any individual meets the above requirements, then he or she may be able to seal or expunge a criminal record. To do so, an application must be submitted for a Certificate of Eligibility to the Florida Department of Law Enforcement. The application must be signed in front of a public notary and submitted alongside a $75 fee and fingerprints. If the Certificate of Eligibility is granted, they will then file a petition to have their criminal record sealed or expunged.
