What Are Parental Responsibility Laws?

We all know that kids make mistakes, but if your child has been involved in a crime, you could be held liable for their actions. In an effort to combat high crime rates amongst minors, the United States has enacted various statutes known as parental responsibility laws. These laws hold parents or guardians liable for any damages or injuries their children cause as a result of intentional or malicious acts. Your child’s actions may have a bigger effect on your life than you think. If you are a parent, here is what you need to know:

What are the Parental Responsibility Laws in Florida?

Parental responsibility laws vary on a state-by-state basis. Some states hold parents and guardians responsible for a variety of crimes, while others are more lenient. In any situation, it is important to know and understand the laws in your area.

Much like other states with the U.S., Florida has enacted specific laws that detail when parents or guardian are responsible for their children’s intentional or malicious actions if they cause damages. In Florida, the parental responsibility laws mainly focus on the following actions:

-Vandalism – Florida Statute 741.24 states that parents or legal guardians of any person under the age of 18 are liable for any minor who maliciously or intentionally destroys or steals property.

-Driving – Any person under the age of 18 must have a verified person sign their driver’s license. Under Florida Statute 322.09, the verified person (typically a parent or guardian) is held liable for any negligent or willful misconduct of a minor while driving.

-Underaged Drinking – Florida prosecutors have increased the level of responsibility for parents who allow their children to have parties where alcohol is served, especially to children who are underage. Parents can be held liable for any accidents or harm which may occur at the party or while a child is driving after the party.
